Article 1: General provisions

The e-commerce website of AQwaTech BV with registered office at Bevrijdingsweg 18, B-8480 Bekegem, BTW BE 0555.711.515, offers its customers the possibility to buy the products from its webshop online.

These General Terms and Conditions (“Terms and Conditions”) apply to any order placed by a visitor to this e-commerce website (“Customer”). When placing an order through the AQwaTech BV webshop, the Customer must expressly accept these Terms and Conditions, by which he agrees to the applicability of these Terms and Conditions to the exclusion of all other conditions. Additional terms and conditions of the customer are excluded, unless they have been previously, in writing and explicitly accepted by AQwaTech BV.

Article 2: Price

All mentioned prices are expressed in EURO, always including VAT and all other taxes or duties to be borne by the Customer.

The shipping costs are stated separately at the end of the ordering process. The overview of the shipping costs can be found below.

The statement of price refers exclusively to the articles as described verbatim. The accompanying photos are for decorative purposes and may contain elements that are not included in the price.

Article 3: Offer

Despite the fact that the online catalogue and the e-commerce website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the offer do not bind AQwaTech BV. AQwaTech BV is only bound to the correctness and completeness of the offered information. AQwaTech BV is under no circumstances liable in the event of manifest material errors, typesetting or printing errors.

If the Customer has specific questions about e.g. sizes, colour, availability, delivery time or delivery method, we ask the Customer to contact us in advance.

The offer is always valid as long as stocks last and can be adjusted or withdrawn at any time by AQwaTech BV. AQwaTech BV cannot be held responsible for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.

Article 4: Online purchases – Description of the ordering process

Below you will find a description of the ordering process of our webshop. It will briefly explain which steps you need to take to place an order, how you can pay and which confirmation emails you will receive.

Step 1: The product

Once you have found the desired product, selected the desired properties, adjusted the quantity if necessary, click on the “Add to basket” button on the product page. Now the selected product will be added to the shopping cart. You can add other products to your shopping cart in the same way or go to the shopping cart to checkout.

 

Step 2: The shopping cart

If you wish to checkout your order, first check your products in the shopping cart, adjust the quantities if desired, then click on Update shopping cart and click on the Continue to checkout button. You will now be redirected to the checkout page.

 

Step 3: Checkout

You are now on the checkout page. Here you have to enter your data (“Invoicing address”). Then click on “Continue”. In the next screen you can enter another shipping address. If you do not enter anything here, the products will be sent to the billing address. Then click on “Continue”.

Then you can select your shipping method.

The shipping costs and the minimum amount for free shipping differ per country. You can find the overview in the table below:

Now you can check your order, agree to the terms and conditions by checking the box next to “I have read and agree to the website’s terms and conditions” and finally you can place the order. To do so, click on “place order“.

Step 4: Payment

You are now redirected to the secure payment page of our payment provider SISOW. Here you need to follow the instructions of the relevant website to complete the payment.

Step 5: Your order has been received by us

You have now placed your order and it has been received by us.

You will then receive an email from us confirming your order. Your order has now been received by us and will be further processed and prepared for shipment.

 

AQwaTech BV is entitled to refuse an order pursuant to a serious breach on the part of the Customer with respect to their orders.

Step 6: Shipment

Once we have received the payment, the ordered products will be shipped to you within 3 working days. As soon as the order has been shipped, you will also receive an email from us (via shop@aqwatech.com) with the tracing link so you can track your order.

Article 5: Delivery and execution of the agreement

Unless otherwise agreed or expressly stipulated, the goods will be delivered to the Customer at the latest within 30 days after receipt of the order.

 

Any visible damage and/or qualitative defect of an article or other shortcoming in the delivery, must be reported by the Customer immediately to AQwaTech BV.

 

The risk of loss or damage shall pass to the Client as soon as he (or a third party other than the carrier and designated by him) has acquired physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by AQwaTech BV.

Article 6: Retention of title

The delivered items remain the exclusive property of AQwaTech BV until the moment of full payment by the Customer.

The Customer undertakes, if necessary, to inform third parties of AQwaTech BV’s retention of title, e.g. to anyone who would seize items that have not yet been fully paid for.

Article 7: Right of withdrawal

The provisions of this article only apply to Customers who, in their capacity as consumers, purchase articles online from AQwaTech BV.

 

The Customer has the right to revoke the agreement within a period of 14 calendar days without giving reasons. The revocation period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, other than the carrier, acquires physical possession of the last good.

 

In order to exercise the right of withdrawal, the Customer must inform AQwaTech BV (Bevrijdingsweg 18, B-8480 Bekegem, info@aqwavit.com, +32 (0)50 69 02 45) of its decision to withdraw from the contract by means of an unequivocal statement (e.g. in writing by post or e-mail). For this purpose, the Customer may use the attached model revocation form, but is not obliged to do so.

 

In order to comply with the revocation deadline, the Customer must send his notice concerning his exercise of the right of revocation before the revocation deadline has expired.

 

The Customer must return or hand over the goods to AQwaTech BV immediately, but in any event no later than 14 calendar days after the day on which he has notified AQwaTech BV of his decision to revoke the agreement (Bevrijdingsweg 18, B-8480 Bekegem). The Customer shall be on time if he returns the goods before the period of 14 calendar days has expired.

 

The direct costs of returning the goods shall be borne by the Customer.

 

If the returned product has in any way diminished in value, AQwaTech BV reserves the right to hold the Customer liable and to claim damages for any diminished value of the goods resulting from the use of the goods by the Customer beyond what is necessary to determine the nature, characteristics and operation of the goods.

 

Only items that are in their original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back.

 

If the Customer revokes the agreement, AQwaTech BV will refund all payments received from the Customer up to that moment, including the standard delivery costs, within a maximum of 14 calendar days after AQwaTech BV has been informed of the Customer’s decision to revoke the agreement. In case of sales agreements, AQwaTech BV can wait with the refund until he has received all the goods back, or until the Customer has demonstrated that he has returned the goods, whichever time comes first.

 

Any additional costs resulting from the Customer’s choice of a method of delivery other than the cheapest standard delivery offered by AQwaTech BV will not be refunded.

 

AQwaTech BV will reimburse the Customer using the same means of payment as the Customer used for the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charged any costs for such reimbursement.

 

The Customer cannot exercise the right of withdrawal for:

 

  • the delivery of goods manufactured according to the Customer’s specifications, or which are clearly intended for a specific person;
  • the supply of goods that spoil quickly or have a limited shelf life;
  • the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene and of which the seal has been broken after delivery;
  • the delivery of goods which, after delivery, by their nature, have been irrevocably mixed with other products;

Article 8: Warranty

Under the Act of 21 September 2004 on the protection of consumers when selling consumer goods, consumers have legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.

 

In order to invoke the guarantee, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer’s home, the Customer must contact AQwaTech BV and return the item to AQwaTech BV at his expense.

If a defect is found, the Customer must inform AQwaTech BV as soon as possible. In any case, any defect must be reported by the Customer within a period of 2 months after it has been established. After that period, any right to repair or replacement expires.

 

The warranty never applies to defects caused by accidents, neglect, falls, use of the item contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, modifications or alterations to the item, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, unless the Customer can prove to the contrary.

Article 10: Penalties for non-payment

Without prejudice to the exercise of other rights available to AQwaTech BV, in case of non-payment or late payment from the date of default, the Customer will automatically and without notice owe an interest of 10% per year on the unpaid amount. In addition, the Customer will automatically and without notice owe a fixed compensation of 10% on the amount in question, with a minimum of 25 euros per invoice.

Without prejudice to the foregoing, AQwaTech BV reserves the right to take back items that have not (fully) been paid for.

Article 13: Impairment validity – non renunciation

If any provision of these Terms and Conditions is declared invalid, unlawful or void, this shall in no way affect the validity, legality and applicability of the other provisions.

AQwaTech BV’s failure at any time to enforce any of the rights contained in these Terms and Conditions, or to exercise any right hereunder, shall not be construed as a waiver of such provision and shall not affect the validity of any such rights.

Article 14: Modification of conditions

These Terms may be supplemented by other terms and conditions when explicitly referred to, and the general sales terms and conditions of AQwaTech BV. In case of inconsistencies, the present Terms take precedence.

Article 15: Proof

The Customer accepts that electronic communications and backups may serve as evidence.

Article 16: Applicable law – Competent court

Belgian law shall apply, with the exception of the provisions of private international law on applicable law.

 

All disputes fall under the exclusive jurisdiction of the courts competent for our registered office. Consumers can also turn to the ODR platform (http://ec.europa.eu/consumers/odr/), but we reserve the right to submit disputes exclusively to the courts.

 

 

Annex 1: Model revocation form

Dear Customer, you only need to fill in and return this form if you wish to revoke the agreement.

The Customer cannot exercise the right of withdrawal for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene and of which the seal has been broken after delivery.
